GSA to issue final version of its AI contract data-safeguarding clause ahead of formal rulemaking
Federal procurement terms tend to become templates for private-sector vendor contracts, so data-handling obligations on LLM suppliers are likely to harden beyond government work. Vendors selling to US agencies should map the clause against their data retention and model-training practices now. Enterprise buyers can borrow its language as a baseline in their own AI contracts.
What Happened
Inside Defense reported on 30 October that the General Services Administration will in the coming days issue a 'final' version of a clause for contracts with AI vendors, as a step toward a formal rulemaking process. The clause, titled 'Basic Safeguarding of Data within Large Language Model Artificial Intelligence Systems', went into effect on 19 October. The report says it has undergone extensive changes since it first appeared in January.
Why It Matters
Federal procurement terms tend to become templates for private-sector vendor contracts, so data-handling obligations on LLM suppliers are likely to harden beyond government work. Vendors selling to US agencies should map the clause against their data retention and model-training practices now. Enterprise buyers can borrow its language as a baseline in their own AI contracts.
