EU AI Act: Article 50 transparency rules now apply; content marking due December 2026, high-risk rules December 2027
The omnibus has fixed the calendar, which removes the planning ambiguity that many compliance programmes cited for waiting. Firms that publish AI-generated content into the EU have under two months to implement marking, while high-risk system providers and deployers should use the extra year to complete inventories, risk classification and documentation. Because AI literacy enforcement sits with national authorities, firms operating in several member states should expect uneven supervisory practice.
What Happened
The AI Act's rules on prohibited practices and AI literacy have applied since 2 February 2025, general-purpose AI model obligations since 2 August 2025, and Article 50 transparency rules since 2 August 2026. Under omnibus regulation 2026/1744, content-marking obligations apply from 2 December 2026 and high-risk obligations from 2 December 2027. The Commission's FAQ says no certificate is needed for AI literacy and that national market surveillance authorities enforce it.
