Walkers analyses Bermuda's Beneficial Ownership Amendment Act 2026 and its FATF alignment
Beneficial ownership regimes are increasingly an operational and data-management obligation as well as a legal one, requiring accurate, current ownership records and processes to maintain them. Entities and service providers should review how ownership data is collected, verified and filed, particularly where records previously flowed through processes designed around the BMA. Closer alignment with FATF standards supports the jurisdiction's standing with correspondent banks and international counterparties.
What Happened
In an analysis published this week, law firm Walkers notes that Bermuda's Beneficial Ownership Amendment Act 2026 received Governor's assent on 14 September 2026. The amendments build on the Beneficial Ownership Act 2025, which requires legal persons to obtain, hold and register beneficial ownership information and moved the central register from the Bermuda Monetary Authority to the Registrar of Companies. Walkers says the changes bring Bermuda closer to international standards, including those of the Financial Action Task Force.
