Oracle sends force majeure notice over power delays at Stargate Project Jupiter campus in New Mexico

AI Infrastructure Laurenceo Intelligence Oracle · United States

The notice places a permitting delay on a gas pipeline at the centre of a flagship AI capacity project, and it shows how that risk is being allocated between tenant and capital provider. Lenders and investors in AI infrastructure should look closely at force majeure drafting, fuel supply dependencies and the permitting status of connecting infrastructure. Enterprises relying on future cloud capacity should not treat announced online dates as firm commitments.

What Happened

Oracle has sent a force majeure notice to a unit of Blue Owl Capital over Project Jupiter, the New Mexico data centre at the centre of the Stargate AI build-out. The notice would allow Oracle to delay payments should the facility miss its 2028 target to come online. The 2.45-gigawatt campus is meant to run on Bloom Energy gas-powered fuel cells, the Energy Transfer pipeline intended to supply it has been delayed nearly six months to 1 February 2027 after regulators repeatedly denied permits, and Oracle said "Project Jupiter remains on our planned schedule".

Why It Matters

The notice places a permitting delay on a gas pipeline at the centre of a flagship AI capacity project, and it shows how that risk is being allocated between tenant and capital provider. Lenders and investors in AI infrastructure should look closely at force majeure drafting, fuel supply dependencies and the permitting status of connecting infrastructure. Enterprises relying on future cloud capacity should not treat announced online dates as firm commitments.
